Yes, you can buy land and develop a property in SMSF. You will need to have enough funds in your SMSF to cover the purchase and development costs. If your SMSF borrows the money to buy property, this property can not be developed. There are other ways to buy and develop property in a SMSF which you can contact us about.

No trustee, member nor anyone related to the fund can live in or rent a property owned by that SMSF. However, if you wish to live in your SMSF property when you retire then the SMSF will need to sell you that property, as long as the rules governing SMSF property sales are adhered to. The property could also be paid out as a lump sum to yourself after retirement. 

The risks of investing your super fund into property need to be evaluated in each case by the trustees, and this is where the expert advice of Easy Super can help.

  • Higher property loan costs for SMSFs
  • Only your fund is permitted to repay the loan so you must maintain good liquidity and cash flow
  • Associated risks of property such as non-paying tenants. 

Yes a SMSF can sell residential or commercial property to a member but the transaction must meet the ‘arms-length’ rule, meaning that the sale must be treated as any commercial transaction, as if no relationship existed between the two parties. 

No. Property owned by a SMSF cannot be lived in or rented by any member, trustee or any other related party. 

SMSFs can generally borrow up to 70% (and in some cases up to 80%) of the property value. Each financial institution will have its own rules around loans to SMSFs, and whether that loan is for commercial or residential use. It’s important to ensure you have enough liquidity in your fund to put down a deposit, pay for all initial transaction fees and cover short term loan repayments.
